This Driver Responsibility Acknowledgment Policy outlines the roles, responsibilities, and expectations of drivers who provide rideshare services through the OMNI platform. By signing the acknowledgment form, drivers agree to the terms outlined in this policy, including an agreement to resolve disputes through binding arbitration.
1. Purpose
This policy establishes the terms under which drivers operate as independent contractors, using the OMNI platform to provide rideshare services.
2. Driver Requirements
To maintain compliance and eligibility, all drivers must:
- Hold a valid driver's license and be at least 25 years old.
- Maintain a clean driving record with no major violations.
- Pass a background check conducted by OMNI.
- Own or access a vehicle that meets OMNI’s operational and safety requirements.
3. Vehicle Requirements
All vehicles used for rideshare services must:
- Be in good operational condition and meet all applicable legal standards.
- Be insured as required by state and local laws.
- Pass an OMNI-conducted or authorized vehicle inspection.
4. Service Standards
Drivers agree to:
- Provide professional, courteous, and reliable rideshare services.
- Use the OMNI app to accept rides and follow in-app navigation for all trips.
- Ensure vehicles are fueled and ready for operation before going online.
- Process all payments exclusively through the OMNI platform and not accept direct payments from riders.
5. Compensation
Drivers will be compensated per OMNI’s payment policies, subject to:
- Adjustments in fares and fees as determined by OMNI.
- A deduction of OMNI’s insurance fee to support app enhancements and coverage provisions.
6. Insurance Policy Overview
Drivers are covered under OMNI’s insurance policy depending on the app usage phase:
- App Off: Personal auto insurance applies.
- App On (Waiting for Requests - Period 1):
- Third-party liability insurance applies if personal insurance does not cover the incident.
- App On (En Route to Pickup - Period 2):
- Third-party liability coverage up to $1,000,000.
- Contingent comprehensive and collision coverage with a $2,500 deductible (if personal coverage applies).
- App On (Ride in Progress - Period 3):
- Third-party liability coverage up to $1,000,000.
- Contingent comprehensive and collision coverage applies as per Period 2.
Important: Personal insurance must meet state minimum requirements. OMNI’s contingent coverage acts as secondary insurance.
7. Conduct Expectations
Drivers agree to:
- Follow all local laws and OMNI policies while using the platform.
- Maintain behavior that protects OMNI’s reputation.
- Avoid conduct that may harm OMNI’s business interests or brand.
8. Termination of Agreement
Either party may terminate this agreement at any time with cause. OMNI reserves the right to deactivate driver accounts for policy violations or other reasons at its sole discretion.
9. Indemnification
Drivers will indemnify and hold OMNI harmless from claims, damages, and expenses arising from their services or conduct.
10. Arbitration Agreement
All disputes between OMNI and drivers will be resolved through binding arbitration, governed by the Federal Arbitration Act (FAA). No lawsuits may be filed in court unless arbitration is deemed unenforceable.
11. Modifications
OMNI may update this policy at its discretion. Updates will become binding upon driver acknowledgment or continued platform use after changes are communicated.
12. Independent Contractor Acknowledgment
Drivers understand and acknowledge that:
- They are 1099 independent contractors, not employees of OMNI.
- They are responsible for their own taxes, insurance, and operating costs.
- They must acquire and maintain the equipment required to fulfill their contracted services.
Certification
By signing up drivers confirm:
- They have read and understand the policy.
- They agree to the outlined terms, including arbitration provisions.
- They will comply with the requirements, standards, and responsibilities specified in this policy.
